Joseph McCloskey Jr., the man who is alleged to have broke into Takeย Five Video on Pond Street in Bristol Borough on September 15, plans a plea of ย guilty to a burglary charge, his public defender told District Court Judgeย Frank W. Peranteau Srย Wednesday morning.

McCloskey remained silent throughout the hearing as attorney’s discussed his pleading with the judge.

In exchange for the his pleading to the top count in the case, all other charges from the burglary were dropped in the deal made between the commonwealth and McCloskey’s public defender.

The plea stems from a report that Bristol Borough police responded to on a Sunday night in September where a silent alarm went off ย at the video store. Police arrived on scene and found ย  the back door of the store pried open with entry made, court records say.

A witness on the scene told officers she had heard a loud banging from an apartment that sits right above the rear entrance to Take Five, police say, and confronted McCloskey, 29, of Bristol, about the noise.

A chase by officers ensued. Shortly afterwards, police captured the would be robber in possession a small black flashlight, red handled screwdriver, a hammer, chisel, two pairs of wire cutters, and five screwdrivers, court papers show.

McCloskey is now scheduled for arraignment in the Bucks County Court of Pleas on December 6.

In a related manner, McCloskey also had a second case dating back to August in which he was charged with receiving stolen property waived on to the court of common pleas for arraignment set for December 6.

McCloskey is currently in Bucks County Prison on 10 percent of ย $5,000.
