Will PennDOT Reimburse For Pothole Damage?

It’s a question many LevittownNow.com readers have asked this year. The answer – likely not.

“Any individual, who believes they have sustained damages as a result of the negligence of the Commonwealth, may file a claim for recovery,” PennDOT says. They add: “The law, however, prohibits the payment of property damage (tires, rims, etc.) as a result of a pothole.”

PennDOT officials said they have never issued a reimbursement for a claim relating to damage. They also note state sovereign immunity law does not allow them to reimburse for damage.

“Although we regret your misfortune in this incident, we are strictly limited by the provisions of the law,” PennDOT’s website reads.

The Allentown Morning Call reported in 2014 motorists who are injured in pothole-related crash might have a case.

“The injured party must show that the accident could have been prevented had the pothole been fixed,” the newspaper noted.
