Falls Township officers attest that on November 22 shortly after 10 a.m. they were dispatched to Walgreens at 8500 New Falls Road for reports of a sexual assault that had occurred earlier in the Elderberry section of Levittown.

The victim said that in the early morning hours of November 22, she had returned to the Elderberry residence and was immediately engaged in an argument with Ferguson. Police recorded in a probable cause affidavit that Ferguson became enraged and began yelling and cursing at the woman before returning to the second bedroom holding a serrated kitchen knife with a black handle saying, “Don’t say anything, I have a knife, get on the bed.”

Court documents state that Ferguson performed oral sex on the woman and penetrated her for approximately 10 to 15 minutes twice during an hour long period while the woman fabricated excuses in an attempt to make the assault stop. The victim told police she feared for her life during the incident.

Ferguson, who has a history with local authorities, was charged with endangering the welfare of children and recklessly endangering another person back in 2013. While the first charge was withdrawn, Fergusonย completed a 12 month ARD program and 10 hours of community service in the recklessly endangering another person offense.

Ferguson awaits a preliminary hearing scheduled for February 9 with District Judge Jan Vislosky.
