Lawyer: Man Cleared Of Charges Brought On After Medical Emergency

Francis Zydzik did not commit a crime, but his lawyer said he did suffer a medical emergency.

During a preliminary hearing before a district judge, Francis Zydzik, 58, of Middletown’s Levittown section, had the charges of disorderly conduct, harassment and resisting arrest dismissed Tuesday.

Keith Bidlingmaier, Zydzik’s defense attorney, said the outburst that caused Yardley police to file the charges in May was brought on by a diabetic episode. The 58-year-old “didn’t have criminal intent to commit the charges,” the attorney said.

Police alleged Zydzik was inside a Wawa causing a disturbance and refusing to listen to them as they attempted to take him into custody.

One of Zydzik’s family members wrote in an email to LevittownNow.com that the 58 year old is a devout Christian and Air Force veteran who was suffering from a diabetic emergency during the Yardley incident.

“Even when we presented evidence today the District Attorney was not budging in withdrawing the charges,” Bidlingmaier said.

The assistant district attorney who prosecuted the case was not immediately available for comment as of press time.

In 2014, Zydzik pleaded no contest to a 2013 incident where Middletown police said he fired a handgun outside his Circle Road home after an argument with his son.
