On Wednesday, charges against two nephews and a niece for attacking their uncle in July were dropped because the key witness in the caseย did not appear at the preliminary hearing ย for a third time
District Court Judge Frank W. Peranteau Sr. told representatives for the commonwealth they were free to represent the case if anything changed but in light of the victim failing to appear for a third court date he had no other choice but to drop the charges against two brothers and sister that attacked their uncle.

A source close to the family who asked not to be identified said no one has seen the victim in weeks later adding that after the original altercation he left the area.
The case stemmed from an alleged attack in which Christopher Davane, 19, of Bensalem; Alan Devane, 22, of Bensalem: and Janine Davane, 18, of Bristol, were accused of beating their uncle in July.

All three attended the hearing Wednesday with legal representation and listened intently as Peranteau made his decision.
