Cruz, according to authorities, is accused of pulling the trigger and killing 34-year-old Emilo Lopez in a failed robbery attempt.
Lopez was walking on Kent Street in the city shortly before midnight on November 16, 2012 when Cruz and three men approached him. They attempted to rob him but Cruz ended up firing a handgun, striking the 34 year old. The three robbers ran off and fled in a minivan, police said.
Investigators said they found Lopez bleeding from the nose and mouth. He was pronounced dead a short time later.
