The mother of the siblings who attempted to rob a Levittown pizza shop last week and the pregnant girlfriend of the one brother were charged Tuesday night.
Robin Lynn Soto, 52, of Middletown, and Chasity Demi Ramos, 25, a former Bristol Borough resident living in Bristol Township, were each charged with conspiracy and robbery. At a quick preliminary hearing in Bensalem, District Judge Joseph Falcone set bail at 10 percent of $2 million with conditions not to contact victims, co-conspirators and witnesses.

The charges come exactly one week after brothers Justin Rose, 22, and Shawn Rose, 24, walked into Porfirio’s II Pizza in the Skyline Shopping Center in Middletown’s Levittown section wearing dark clothing, surgical gloves and masks around closing time with what appeared to be real guns. After threatening the two employees and a lone customer, the brothers allegedly pistol whipped the customer, a local man who served in the military. The 35-year-old customer seized the opportunity when Shawn Rose looked away and pulled his personal Glock .45 handgun from his jacket and shot the brothers, killing the 24-year-old.

According to court papers filed Tuesday night, Soto and Ramos checked out the pizza shop about 10 minutes before the attempted robbery to relay back to the brothers how many people were in the business. One of Porfirio’s II Pizza’s owners recalled to police that Soto entered the store and asked what time they were open until and then left with Ramos.
Police said that Justin Rose was on the phone with Ramos, his pregnant girlfriend, and Soto, his mother, when the attempted robbery went bad and the customer defended himself.

Shawn Rose died on the floor of the pizza shop with a single bullet to the torso and Justin Rose remained hospitalized at Thomas Jefferson University Hospital in Philadelphia as of Tuesday morning with a bullet wound to the neck.

“Several hours after the robbery, Soto and Ramos went to the Middletown Township Police Department seeking information about the condition of Shawn and Justin Rose. At that time, the co-owner of Porfirio’s identified them as the women who had entered his business just before the robbery,” authorities said in a statement.
Another new revelation that was in the court papers filed against the two women was that Justin Rose told detectives Monday that he planned the robbery with his brother a few days in advance.

A warrant against Justin Rose on charges of robbery, conspiracy, simple assault and reckless endangerment was filed Tuesday. The 22-year-old Levittown man is expected to be arraigned once his hospitalization allows for the court action.District Attorney Matt Weintraub said the two guns the Rose brothers used in the attempted robbery turned out to be pellet guns with their orange caps removed.

The customer who shot the brothers has wished to remain anonymous and was cleared of wrongdoing by Weintraub. However, the district attorney did state the customer did have an expired concealed carry permit for his Glock .45 handgun but will not be charged after prosecutors looked at the totality of the situation.
“If [the armed customer] would not have been here, it would be different right now,” Porfirio’s II Pizza co-owner Gilmer Porfirio told reporters last week. He added that the customer is now part of the business’ family.

Authorities said Ramos had a retail theft case in her past and Soto had no criminal record before Tuesday.
