Homicide Charge Against Suspected Getaway Driver In Fatal Failed Robbery Withdrawn

The suspected getaway driver who waited outside the Pennsbury Pharmacy last Friday morning while his co-conspirator attempted to rob the family-owned business had the homicide charge filed against him dropped Thursday.

Bucks County District Attorney David Heckler confirmed to LevittownNow.com that the homicide charge lodged against 55-year-old Kim Goldsboro of Camden has been dropped. Charges of conspiracy to commit robbery, receiving stolen property and possession of an instrument of crime will be refiled Thursday afternoon and the New Jersey resident will be re-arraigned.

Last Friday, only hours after the fatal self-defense shooting in Falls Township, Heckler said the homicide charge was being lodged because the robber – later identified through fingerprints as Willie A. Bozarth, 33, of Sewell, New Jersey – died due to actions Goldsboro took. The pharmacy owner who shot Bozarth in self defense has been cleared of any wrongdoing.

Heckler said further investigation by lawyers, clerks and interns in his office found an over 100-year-old case that placed doubt as to whether the homicide charge could be filed if the suspect was shot dead by an innocent person in self defense.

“This was contrary to my belief and the belief of a lot of people in this office,” he said.

The district attorney said his office is continuing further research and he was not “100 percent satisfied” that the homicide charge had to be dropped. He added that the homicide charge would be refiled if his office determined the charge would be permissible.

Goldsboro will be re-arraigned and will have a new bail set. He was remanded to prison without bail after the shooting due to the fact he was facing a homicide charge. Heckler said it would be fair if he received a bail amount in light of the most serious charge being dropped.

“It’s not right to deprive him of bail,” Heckler said.

“I think its a pretty sure bet he won’t be going down to the shore this weekend,” Heckler said, adding the charges were still pretty serious and his office was requesting a high bail.

During his preliminary arraignment on the homicide charge last week, Goldsboro cried as District Judge Jan Vislosky arraigned him before investigators and a handful of reporters.

“I know you’re having a rough day,” Vislosky told him during the arraignment.
