EXCLUSIVE: Decision On Charges In Water & Sewer Authority Investigation Could Come Soon

Bucks County District Attorney David Heckler is preparing to review evidence related to a months-long investigation into the Lower Bucks County Joint Municipal Authority, which provides water service to more than 65,000 people in Levittown.

The investigation involves the finances of the Bristol Township-based LBCJMA and compensation doled out to at least one now-former employee, Heckler said.

The district attorney said detectives are preparing a written summary of the case to present for review. Heckler said he could not comment on whether charges will stem from the investigation, but a decision could be coming in the next few weeks.

LBCJMA officials directed a reporter to solicitor James A. Downey III of Middletown law firm Begley, Carlin and Mandio for comment on the investigation. Several attempts in recent weeks to reach Downy by phone have proved unsuccessful.

LevittownNow.com has reviewed a forensic audit of the pay for the LBCJMA employee who is under investigation. Sources have reported the audit, which was performed by Barbagallo & Associates of Yardley, was among the documents detectives have obtained from the LBCJMA.

The February 2015 forensic audit obtained through a source shows the former employee was overpaid by $26,399 over the course of their employment, which ended in 2014. The attorney for the former employee said the audit did not paint a complete picture and was incorrect.

According to LBCJMA Board of Director meeting minutes from February 28, 2015, a forensic audit was set to be submitted by Downey to the Pennsylvania Ethic Commission and the Pennsylvania Municipal Pension System for review. Meeting minutes for the following months do not mention the audit again.

Eric Landamia, a detective with the Bucks County District Attorney’s Office detectives unit, is leading the investigation, Heckler said. Since joining the county, the detective has worked investigations into crooked contractors and financial crimes.
