
A Middletown man is accused of making threats in front of a police officer and damaging a holding cell at the station.
Brian Herbert Jr., 42, was charged early Saturday with two counts of terroristic threats and single counts of institution vandalism and possession of a controlled substance. He is being held at the Bucks County Correctional Facility on 10 percent of $25,000 bail.

According to Middletown police, officers were called to the 700 block of Parkview Avenue around 11 p.m. Friday for a report that a protection from abuse order was violated.
Upon arrival, Officer William Gredone found Herbert laying on the kitchen floor. The officer confirmed the PFA and learned the woman residing at the Parkview Avenue home had been letting Herbert stay at the house under the agreement that he would not get intoxicated. She also said Herbert agreed not to be in the house Friday night when she brought her children home, according to court papers.
Herbert appeared to be highly intoxicated and reportedly told the woman he was not leaving, police said.

Herbert was taken into custody and found to have a prescription Suboxone strip without possessing a prescription, police said.
While being transported by Gredone, Herbert reported said he was going to kill the woman and her “ex” by slicing their throats “ear to ear,” court papers stated. They noted he also added it wasn’t a threat but a promise.

The night continued to be escalate at the police station when Herbert ripped the video and surveillance camera from the ceiling of the holding cell he was in, authorities said.
The threats made in the car were recorded by police on video.
Herbert is scheduled to have a preliminary hearing before District Judge Daniel Baranoski on January 13.
