Lawsuit: Driver In Fatal Crash Had Repeated Safety Violations

The widow of a truck driver who was heading to a Falls Township business when he was killed in a crash has filed suit against a trucking company.

Maria Mirys of Ewing, New Jersey claims in legal paperwork filed this week that 58-year-old Paul Mirys’ death was the result of negligence by Oregon-based Booster Transport LLC and tractor-trailer driver Anatoliy Baranovich.

Paul Mirys, a father of three sons, was killed after being trapped under his scrap metal-filled truck when it overturned in the northbound lanes of I-95 near Street Road in Bensalem on January 15, state police said at the time.

The lawsuit claims the tractor-trailer driven by Baranovich rear-ended a car that caused the chain reaction crash. The crash caused Paul Mirys’ to hit the highway guard rail where his truck overturned and he became trapped, according to the lawsuit.

“As the direct and proximate result of Defendant Baranovich’s actions, Paul Mirys suffered pre-impact fear, severe physical and mental injuries and conscious pain and suffering from which he ultimately died,” the lawsuit filed Thursday in Bucks County court reads.

Maria Mirys said in the lawsuit that “that Booster Transport negligently hired, trained, and entrusted its truck to Baranovich, who should not have been permitted to continue driving after repeated safety violations,” according to a statement from law firm Baum, Hedlund, Aristei and Goldman, the lawyers representing Maria Mirys.

The Mirys family said Paul Mirys was a devoted father and husband. He was know for willingness to help others.

Maria Mirys and her sons are suing for punitive damages, medical expenses and exemplary damages.

As of Friday morning, no criminal charges had been lodged against Baranovich in connection with the crash.
