Neshaminy School Board President Scott Congdon announced at Tuesday’s meeting that Bucks County Judge Robert Mellon dismissed a legal challenge filed against the district.
The claim was filed by Levittown residents Natalie Chamberlain, Karen Saraullo, Christy Dougherty, Jennifer Wilityer and Kimberly Mason. The four asked Mellon to force the district to overturn the closure of the Samuel Everitt Elementary School in Levittown, which is planned to happen later this month.

“We believe the Judge Mellon did the right thing in this case by upholding the decision of the school board to do what they think is best for all the students,” Congdon said.
In May, a hearing was held in Doylestown before Mellon, a former Council Rock School Board member.
According to the legal paperwork filed by attorney Peter Williams, the complaints claimed the information found on the resolution the school board approved did not match evidence the district has provided elsewhere. The legal challenge lays out differences between information found on the Neshaminy website and information in the resolution.

At the hearing, school board members Ron Rudy and Mike Morris, who are both opposed to the closing of schools, testified along with members of the district staff, construction team and the director of the Bucks County Intermediate Unit, which has signed a lease to take over Everitt starting this summer.
The final cost for the district’s legal fees has not yet been released.
