Rape Charge Dropped, Others Forwarded to Trial


At a preliminary hearing on Wednesday, several charges including rape and indecent assault were withdrawn against a homeless woman accused of sexually assaulting a 13-year-old boy.

Bethann Wagner, 26, had charges including statutory sexual assault, indecent assault on a person under 16 and corruption of minors forwarded to trail by District Judge Daniel Baranoski. Charges of unlawful contact with a minor and misdemeanor furnishing alcohol to a minor were added by the district attorney’s office.

According to court papers, Wager sexually assaulted the 13- year old inside two houses on Washington Avenue in Middletown in August.

The teen said Wagner poured a cup of vodka in his mouth, straddled him and then began kissing him during the sexual assault, court papers say. Another boy said he witnessed Wagner make out with the 13-year-old boy, police said.

Following the kissing,  Wagner and the 13 year-old went to another house across the street. In an upstairs bedroom, the woman sexually assaulted the boy, court papers say. The documents also outlined the woman’s  attempt  at having sex with the boy, but he refused and left.

The boy went back home and told his parents Wagner tried to have sex with him, according to court papers.

At the time of her arrest, Wagner was also wanted on an bench warrant for failure to appear for her formal arraignment in Doylestown for a simple assault case. The trial in that case is expected to begin Tuesday.

Wagner remains in county prison unable to post 10 percent of $350,000 bail.
