In an almost two hour long preliminary hearing, the two men charged for an alleged gunpoint rape in August will now go before a court of common pleas judge for trial.

Bristol Borough District Court Judge Frank W. Perenteau Sr. said the commonwealth has met its burden and waiving on the nine charges for each man to Doylestown.

The hearing itself was filled with a little of everything from a legal stand point as debates between the suspects’ attorneys and prosecutors from the Bucks County District Attorney’s office on issues of sequestration, having the name of the victim used in open court and information about charges for one of the two being entered in the court system data base incorrectly took place.
Perenteau even had to warn members of the gallery that he would clear the court if another “outburst” occurred during the victim’s testimony.

The victim testified that a man she referred to as Kareem (Evans) called her as a result of an ad she had on a website called backpages.com and wasย toย meet him on Market Street, she testified. After arriving at the address, she said was different that the one Evans provided, they entered a Ceder Street home that was empty. She added there were no lights on, which led her to ask for lights to be put on, as they both walked towards a room that she described as a bedroom.
She then testified that Evans returned with a hoodie on and minutes later they both heard a sound, which led the victim to ask did he have anyone with him. Evans, according to testimony, he said he didn’t.

She testified that a second man, allegedlyย Qudre McMillan entered the room holding what she described as a black shotgun. At this point, she said Evans approached her and started to choke her till she was nearly unconscious. She described the alleged grip the suspect had on her with his forearm on her throat and hand over her mouth and nose.
Evans said, “If you scream I’m going to fucking kill you,” she testified. She added he then demanded she perform oral sex on him, which she testified she did while crying in a corner in the hallway. She subsequently said she was forced to perform a sex act on McMillan too.
She pleaded with the men. “I kept yelling, I have children,” she testified.

The victim testified with anger and defiance in her voice for most of the time she was on the stand, often glaring at the defendants, as the many objections called for by Assistant District Lindsay Vaughan were affirmed by Perenteau.
The victim said she never got her phone back nor did she get paid.

Bucks County Detective Eric Landamia, who took part in the investigation, testified that Evans admitted he called the victim for sex and that she charged $150 for an hour of service. Evans, Landamia said, claimed he performed oral sex on the woman, and she performed it on him. Then, Evans and the woman had intercourse, the detective said.
Landamia said Evans claimed he paid the woman.

Bucks County Detective Tim Carroll testified he executed a search warrant at Evansโ home where he recovered a cellphone that matched the description of the victim’s phone. Carroll also testified McMilan admitted that he and Evans had sex with the woman.
The two hour hearing was held up in the beginning for about 30 minutes due to objections by the defense that the woman be allowed to use an alias as she testified. The commonwealth decided subsequently that the victim would not use an alias.

After the hearing was over, Macmillian’s attorney, Matthew Razzano, was asked about the alleged gun used in the during the purported rape. “Did you hear any testimony from the detectives about a gun? As far as we’re concerned there was and is no gun. We have yet to see any evidence supporting that accusation,” he said.
Both men remain jailed on 10 percent of $5 million bail each.
