Volio is accused of trying to purchase a shotgun from a Scranton shop in 2013.
Scranton police said Volio lied on a background check form and said he was able to by a firearm. They alleged the 45-year-old is unable because he was committed to a mental health facility.
District Judge Joanne Kline set bail for Volio at 10 percent of $75,000. He will likely be transported back to Scranton and arraigned on the gun purchase charges.
