A 18-year-old Penndel man accused of raping an underage girl has waived his right to a preliminary hearing.
Joseph Mortimer had charges of rape, statutory sexual assault, involuntary deviant sexual intercourse with a person less than 16 years old, aggravated indecent assault and indecent assault waived to Doylestown on Wednesday afternoon before District Judge Daniel Baranoski.

According to an affidavit of probable cause, Mortimer raped a 13-year-old girl on January 5 after she invited him over to help her take down Christmas decorations with her family.
Police said Mortimer followed the girl in to her room as she went to get her phone. He reportedly knocked her onto her bed. From there, he took her pants off and then his.
Mortimer attempted to have her perform a sex act on him but she resisted. Moments later, he began performing an unwanted sex act on the girl, according to police. Court papers say, Mortimer eventually had sex with the girl while holding her hands behind her back.

Mortimer, who met the girl through an acquaintance and told her he was 16, is accused of raping the girl while she was kicking “a little bit” and crying, police said in court papers.
After the rape was over, Mortimer told the girl’s sister he had sex with her and then left the house, according to court documents.

When interviewed by police, Mortimer, according to court papers, admitted to several of the allegations.
Mortimer was initially invited of the girl’s house to help her family take down Christmas decorations.
Mortimer has been previously arrested for crimes in Middletown and another incident in Penndel while he was a minor. He has previously been in juvenile detention and was taking part in programs from the state Youth Services Agency at the time of his arrest.

Mortimer remains in county jail in lieu on 10 percent of $250,000 bail.
