Lewis was already charged by the Philadelphia District Attorney’s Office with the murder of a police officer and related offenses. The district attorney’s case against Lewis remains active.

U.S. Attorney for the Eastern District of Pennsylvania David Metcalf announced the federal charges during a press conference alongside Philadelphia Police Department Commissioner Kevin Bethel and Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Special Agent in Charge Eric DeGree.

According to the indictment, Lewis was carrying a loaded 9mm semiautomatic, privately manufactured firearm, which is often referred to as a “ghost gun,” and a loaded 12-gauge short-barreled shotgun on the night of Oct. 10.

Lewis allegedly shot Officers Shane Seiber, 40, of Bensalem Township, and Hector Rodriguez III before stealing a police-issued Glock 17 9mm handgun from the wounded Rodriguez.

Lewis had a prior conviction for a crime punishable by more than one year in prison, and he was legally prohibited from possessing firearms or ammunition.

โ€œNo one attacks law enforcement without facing the consequences,โ€ Metcalf said. โ€œOur thoughts remain with Officer Seiberโ€™s loved ones and the Philadelphia Police Department. We also continue to pray for a swift and complete recovery for Officer Rodriguez. We can never right the terrible wrongs of October 10, 2026. But we can and will bring the person responsible to justice.โ€

If convicted on the federal counts, Lewis faces a mandatory minimum sentence of 10 years in prison up to a maximum penalty of life imprisonment.

โ€œFrom the morning we lost Sergeant Shane Seiber, and Officer Hector Rodriguez suffered devastating injuries, our federal partners stood beside our officers and their families with compassion, resources, and an unwavering commitment to justice,โ€ Bethel said. โ€œThese charges represent another important step toward justice for Shane, Hector, and their families.โ€

Lewis was acquitted several years ago in connection with a fatal road-rage shooting in Philadelphia.

Seiber, who was promoted posthumously to the rank of sergeant, was a U.S. Air Force veteran who joined the Philadelphia Police Department in 2016.

Born in Trenton and raised in Levittown and Langhorne, he attended the Neshaminy School District.
