

A Middletown Township man allegedly photographed another man in a Planet Fitness men’s restroom stall earlier this month.

Nicholas Brown-Difalco, 27, of Middletown Township, was preliminarily arraigned on charges including photography of a sex act and resisting arrest.
Middletown Township police were called to the gym’s parking lot on East Lincoln Highway at approximately 4:45 p.m. Tuesday, Oct. 7, for a report of a person taking pictures of others in the men’s restroom.
An off-duty Bristol Township police officer first reported seeing an argument between Brown-Difalco and another man in the parking lot. The off-duty officer told police the man stated Brown-Difalco had been photographing him while he was in a restroom stall, according to court papers.

The alleged victim told police he was in a stall when he observed Brown-Difalco use a phone’s flash beneath the divider to take a photo of his genitals, police said.
When Middletown Township police spoke with Brown-Difalco, he allegedly admitted to taking pictures of the other person’s private parts but said he had deleted the images from his phone. Brown-Difalco stated he was “curious to see what other men’s genitals looked like,” court documents allege.

Police stated Brown-Difalco “struggled and resisted arrest” as officers attempted to take him into custody.
Brown-Difalco was preliminarily arraigned recently by on-call District Judge Corryn Kronnagel, who set bail at 10 percent of $50,000. He was later released after posting bail.
