For the second time, the Phase II application for Elcon’s proposed hazardous waste treatment facility in Falls Township has been returned as incomplete by state regulators.
The Pennsylvania Department of Environmental Protection (DEP) issued a statement to LevittownNow.com and other media outlets Tuesday that said their regulators determined Elcon’s application was “administratively incomplete.”

A letter sent from the DEP to Dr. Rengarajan Ramesh, a consultant for Elcon, points out that regulators believe the application that was submitted last fall does not include authorization from all property owners. The letter notes Elcon is not the sole owner of the surface and subsurface of the 33 acre lot at 100 Dean Sievers Place.
“DEP reviewed the submitted response and found the supplemental information to be deficient. DEP is requesting additional documentation regarding land ownership and land use consent for the proposed location,” state officials said in a statement.
Elcon will have 90 days to reply to the DEP’s letter. The 181-page Phase II application may be resubmitted and regulators will have 90 days to determine if it is administratively complete.

The return on the application this week does not mean the DEP is denying Elcon’s proposal for a proposed 100,000-square-foot facility that would be constructed on 22 of the properties 33 acres.
While Elcon officials and some supporters have advocated for the hazardous waste treatment facility, numerous environmental groups and local residents have spoken out over the past few years in opposition of the Elcon facility. The have raised concerns over the treatment process, proximity to the Delaware River and other health concerns.

In May 2017, DEP returned the Phase II application the first time. The listed deficiencies included items related to land use and zoning, ownership of the property at 100 Dean Sievers Place, the movement of a proposed stormwater basin, documents relating to Elcon’s name and license in Pennsylvania, and documentation on a geologic analysis.
