A Northampton woman has filed a lawsuit in Bucks County Common Pleas Court after she allegedly found a dead rodent in her Chick-fil-A sandwich.
Ellen Manfalouti’s lawsuit is “seeking money damages for negligence, intentional infliction of emotional distress, product liability and breach of implied warrant, as well as punitive damages.” The suit was filed by Manfalouti’s attorney, Bill Davis of law firm McMonagle, Perri, McHugh and Mischak, and is against Chick-fil-A franchise owner Dave Heffernan and the Middletown location.

Manfalouti, according to the lawsuit, bit into some of the sandwich and discovered the rodent baked into the bun on November 25, 2016. The sandwich was purchased by her friend from the Chick-fil-A off Oxford Valley Road in Middletown.
Manfalouti went to a local hospital for extreme nausea and was prescribed medication, according to the lawsuit.
“I had anxiety and nightmares, which I still do,” Manfalouti told Philly.com. “The first month was really rough.”

Davis told LevittownNow.com that the company that baked the bun’s insurance company paid to have a laboratory to test the apparent rodent remains. The results showed that the sample was a “rat/mouse.”

Photos attached to the lawsuit appear to show a small blackened rodent carcass with legs, a tail and whiskers.

Philly.com reported the lawsuit was filed after Davis tried to come to a settlement but made little progress with their insurance company.
The lawsuit alleges that Dave Heffernan and the Chick-fil-A location did not do their job to make sure their food was “free of rodents or other vermin.”

As of Monday evening, LevittownNow.com was not able to get in touch with Heffernan or Chick-fil-A corporate public relations. However, the Philly.com article attributed the following statement to the company and Heffernan: “We’re not going to make any comment about any allegations. It’s an ongoing allegation and investigation.”
