Francis Neisser was sentenced to four to 10 years in prison. He was also sentenced to five consecutive years of probation and ordered to pay $3,320.82 in restitution.

His brother is set to be sentenced next month.

The brothers were arrested for stealing from Walgreens and Ruger’s Beer and Soda along New Falls Road as part of a scheme to resell the stolen cigarettes to support Francis Neisser’s drug habit. He had a dependency on heroin, crystal methamphetamine and crack cocaine.

Francis Neisser has a history of burglary and theft cases from the 1980s. The criminal history played a role in his longer sentence and led to Judge Wallace Bateman denying a plea for leniency.

Daniel Neisser is expected to fare better than his brother due to having a criminal history of only DUI.
