Man Charged After Allegedly Passing Suspected Xanax Pill To Brother During Preliminary Hearing

Police have charged a Penndel man after they say he passed a suspected Xanax pill to his brother during a preliminary hearing.

Michael Scuderi, 40, was charged with two felonies, including manufacture, deliver, or possession with intent to manufacture or deliver, and contraband of a controlled substance. He was arraigned by District Judge Robert Wagner Jr. and released on $50,000 unsecured bail.

Police allege in court documents that Scuderi was attending a preliminary hearing for his brother Neil on Tuesday morning. His brother was before Wagner on four felony charges, six misdemeanor charges and five summary charges in a late April incident with Tullytown Borough police.

According to a probable cause affidavit, following the hearing, police observed Neil, who was in custody with handcuffs and shackles, walk towards the wooden divider where his brother sat. With an open hand and a clenched fist, he then turned and walked towards the room where the defendants were sitting.

When the constable on hand checked Neil’s hand, he observed one white pill, thought to be suspected Xanax. “Officer, I swear I didn’t know my brother intended to give me the pill,” Neil told police. He later told police the pill was wet and that he was trying to shake it off his hand when he was approached by the constable.

Scuderi had since left the courtroom and was pulled over by police near the Golden Dawn Diner at Five Points. He was taken into police custody and charged.

Police noted in court documents they intend to also charge Neil in the incident.

Scuderi awaits a preliminary hearing for this incident set for July 14.
