A Bristol Township man is accused of stealing loaded pistols from a Falls Township apartment.

A resident of the Village of Pennbrook complex on Penn Valley Road called police Wednesday after he noticed two loaded pistols, a game controller, DVDs, video game disks, a Go Pro camera and several other items were taken from a box he packed in preparation for a move. The resident found several other items were stuffed in the box to fill the void of the the stolen items, police said.

The resident told investigators that Justin Toner, 28, had been staying at the apartment and helping him pack. Toner “turned white as a ghost” when the resident noticed the guns were missing, police said.

Detective Gregory Small wrote in court papers that he spoke with Toner’s girlfriend at her home in Langhorne. After saying she had not talked to Toner since Sunday, the detective had her call him, according to court papers.

“Are they there?” Small heard Toner say on the phone. The detective believed the 28 year old was talking about police.

“They are,” the woman reportedly responded.

The detective then, according to court papers, spoke to Toner and set up a meeting time and location.

At 4:30 a.m. on Thursday, Small met with Toner in the parking lot of the Fairless Hills Burger King. He told the detective the resident often left his doors unlocked and that the gun was likely stolen in a burglary, according to court papers.

The resident contacted police and reportedly said he discovered a photo of one of the pistols on Toner’s Instagram account. The image was taken days before the theft was reported, Small wrote in court papers.

In an interview at the police station, Toner turned over his social media information and it was discovered he was trying to sell stolen DVDs online, police said.

A friend of the resident spoke to him and said he bought a Go Pro camera from Toner. The camera was later discovered to be the resident’s, according to court papers.

Toner was charged with three counts of theft, two counts of receiving stolen property and possession of a prohibited firearm. He was arraigned late Thursday night and sent to prison on 10 percent of $50,000 bail. He is scheduled to come before a district judge on March 6.
