Consumer Corner: Can Landlord Force Me Out?

eviction noticeQ. I received an eviction notice in the mail last week that states that I have only two weeks to be moved out of my apartment. Although I have been looking for a place since receiving the notice, I haven’t been able to find another place to move to.  Can they force me out even if I have nowhere else to live? –  F.T., Chalfont

A. Unfortunately in this particular case, they can.  The owner of the apartment complex seems to have followed the procedure by filing the eviction notice within the small claims court and the judgment was handed down in the landlord’s favor.  Since no appeal to the judgment was filed by you within the time frame allotted, you must be moved out within the two week time frame you were given. If you do not move out by the date specified, the landlord may request an Order of Possession.  An Order of Possession gives the landlord permission to change the locks on your apartment door.

A representative from our office was able to give you a list of local housing assistance centers. Housing is available to you at one of the centers but, keep in mind that the living arrangements made for you at the center are only temporary and you must find a more permanent residence.
