Sexual Assault Case Falls Apart At Trial

The sexual assault case against a Bristol Township man fell apart during trial last week.

Antonio Nathan Hernandez, 20, walked into court facing trial on four counts of aggravated indecent assault and indecent assault and two counts rape and sexual assault. However, the next day he left the Bucks County Justice Center after pleading no contest to a single count of simple assault and getting a sentence by Bucks County Judge Diane Gibbons to one year of probation.

According to court records, the Bucks County District Attorney’s Office did not press forward with the sexual assault charges and swapped those out for the single second-degree misdemeanor charge of simple assault on the second day of the trial.

Hernandez was charged last May with raping a woman at a home on Goodturn Road in Levittown in August 2017. The woman had stated she took acid hours before, while Hernandez was sober. A second woman came forward and said Hernandez raped her in Bristol Borough while the two were in high school, court papers stated.

Ron Elgart, Hernandez’s attorney, said there were problems that came to light when one of the women involved took the stand during the trial.

Hernandez spent a week in the county prison following his arraignment on the charges last year. He was freed on $7,500 cash bail and remained free with an electronic monitoring device until trial, court records state.
