The Falls Township Board of Supervisors last month approved an indemnification and hold harmless agreement with the developer.
The agreement allows Wawa to begin some construction of the 5,585-square-foot convenience store with eight fueling spots on a roughly 2-acre site at Fairless Hills Shopping Center at 500 Lincoln Highway at the corner of Arleans Avenue and Lincoln Highway in Falls Township. The construction can begin while Wawa is awaiting approval from the Pennsylvania Department of Environmental Protection.
Township solicitor Mike Clarke said the agreement allows Wawa to “being at their own risk.”

“The township is indemnified from allowing them to begin this project,” Clarke said.
The new Wawa will be constructed at the site that formerly was home to Arosso, A Touch of Sicily Italian-style restaurant. Arosso recently opened in a new location in the shopping center.
Wawa will have a right-turn only entrance along Lincoln Highway, connections to the shopping center, and an entrance and exit along Arleans Avenue. They also have agreed to a six-foot-wide sidewalk along Lincoln Highway and upgrades for pedestrian safety at the intersection.

Wawa had planned a drive-thru window attached to the building, but those plans were dropped, a township spokesperson previously said.
Wawa operates 10 locations in the Levittown area.
In addition to the new Falls Township site, there is a location under construction along Levittown Parkway in Tullytown Borough and East Lincoln Highway in Middletown Township.
